  1. Promotion Period: The AT&T 26 Days of Giveaways (the "Promotion") begins 12:00:01 a.m. ET on November 7, 2008 and ends 11:59:59 p.m. ET on December 2, 2008 (the "Promotion Period"). The Promotion consists of a series of daily drawings, each of which is a separate, distinct sweepstakes (each, a "Daily Drawing"). The entry period for each Daily Drawing begins each morning at 12:00:00 a.m. ET and ends at 11:59:59 p.m. ET the same evening (each such period referred to as the "Daily Entry Period").

  2. Eligibility: Open to legal residents of the fifty United States and the District of Columbia, who are AT&T wireless subscribers, and who are 13 years of age or older as of November 6, 2008. Employees of AT&T, Yahoo! Inc., Seismicom, Inc., and each of their respective parents, subsidiaries, divisions, affiliates, suppliers, distributors and advertising, promotional and judging agencies, including Don Jagoda Associates, Inc. (collectively "Sponsor and its Administrators") and the immediate family members of each, are not eligible to participate or win. Void where prohibited.

  3. How to Enter: Via Cellular Phone: During the Promotion Period, first you will need to register for the Promotion by visiting www.ATTGiveaways.com, registering and providing your @yahoo.com, @ymail.com or @rocketmail.com email address ("Yahoo! email address"). If you are not an existing Yahoo! email address holder, visit http://www.yahoo.com to create a free Yahoo! ID and @yahoo.com, @ymail.com or @rocketmail.com email address. You will be asked to provide your first and last name, physical mailing address (no post office boxes), telephone number, and email address. You may also be asked to answer optional questions; however, they need not be answered in order to be eligible for the Sweepstakes. Once you have registered for the Promotion, if you have an AT&T Internet-enabled cell phone, log into your Yahoo! Mobile account (using the Yahoo! email address you registered with initially) by going to m.yahoo.com on your phone and clicking on mail ("Mobile Entry") to automatically be entered into the current day's Daily Drawing only. Entries into one Daily Drawing are not included in any other Daily Drawings in the Promotion. Entries for a particular Daily Drawing must be received by the close of the relevant Daily Entry Period. The final Daily Entry Period closes at 11:59:59 p.m. ET on December 2, 2008. You will be charged for the Internet time from your handset according to the terms in your AT&T wireless rate plan. (Contact AT&T for pricing plans and details.) All entrants (using this method of entry) must have an AT&T Internet-enabled cell phone and AT&T service to enter the Promotion. Internet capability is not available on all handsets. Limit one entry per person/per day, regardless of method of entry.

    Free Mail-in Method of Entry: During the Promotion Period, if you wish to enter the Promotion without using Yahoo! Mobile on your AT&T phone, on a plain piece of 3" x 5" paper, hand print your AT&T mobile telephone number, name, Yahoo! email address, complete address, including Zip code and date of birth and mail your entry in a hand-addressed stamped envelope to: AT&T 26 Days of Giveaways, P.O. Box 7914, Melville, NY 11775-7914. All mail-in entries will be included in the Daily Drawing associated with the Daily Entry Period in which the entry is postmarked (from November 7, 2008 through December 2, 2008); mail-in entries postmarked on any given Saturday during the Promotion Period will be included in the following Sunday's Daily Drawing as well. Limit one mail-in entry per person/per day, regardless of method of entry. Each mail-in entry must be postmarked no later than December 2, 2008 and received by December 9, 2008. All entries become the exclusive property of Sponsor, and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different wireless devices, e-mails, Yahoo! email addresses, telephones, identities, registrations and logins, or any other methods will void that participant's entries and that participant may be disqualified. Sponsor is not responsible for lost, late, incomplete, invalid, postage-due, mistranscribed, illegible, unintelligible, misaddressed, or misdirected cell phone Internet service or mail-in entries, which will be disqualified. In the event of a dispute as to a cellular or email address, the authorized account holder of the mobile telephone number (“MTN”) and corresponding authorized account holder of the Yahoo! email address will be deemed to be the entrant. The "authorized account holder" of a MTN is the natural person in whose name the phone has been issued. The "authorized account holder" of the Yahoo! email address is the individual who is both the authorized holder of the Yahoo! ID and password associated with the account (based upon information submitted at the time the account was created or updated upon registration for this Sweepstakes) and, if available, the "authorized email account holder" of the "alternate email address" provided when the Yahoo! ID was created. "Authorized email account holder" is defined as the natural person assigned an email address by an internet access provider, online service provider, or other organization (i.e., business, educational institution) responsible for assigning email addresses for the domain associated with the submitted email address. A potential winner may be requested to provide Sponsor with proof that he/she is the authorized account holder of the MTN phone and the Yahoo! email address associated with that winning entry. If the authorized account holder of the Yahoo! email address cannot be established to the Sponsor's satisfaction, that entry will be disqualified and an alternate winner selected by random drawing.


  4. Random Drawings: On or about January 5, 2009, one winner will be selected for each Daily Drawing during the Promotion Period, in separate random drawings from all eligible Mobile entries received during each corresponding Daily Entry Period and all mail-in entries postmarked that corresponding Daily Entry Period. For Daily Drawings corresponding to a Sunday, the random drawing will be conducted using all eligible Mobile entries received during that Sunday’s Daily Entry Period, and all mail-in entries postmarked the previous day (Saturday). Non-winning entries from a particular Daily Drawing will not be entered in any subsequent Daily Drawings. Random drawings will be conducted by Don Jagoda Associates, Inc. ("Administrator"), an independent judging organization whose decisions are final on all matters relating to the Promotion. Odds of winning a particular Daily Prize will depend upon the total number of eligible entries received/postmarked for inclusion in that Daily Drawing. All prizes will be awarded and winners notified by phone/email. Standard wireless rates will apply if notified by phone. No substitution or transfer of prize permitted except at the sole discretion of the Sponsor. Income and other taxes related to the prize are winner’s sole responsibility, if applicable.

    Average total retail value of all prizes: $6,968. AT&T wireless service plan associated with activation of a phone prize is not included and will be the responsibility of each winner. Gift cards are subject to restrictions and expiration dates as set forth on the gift card. Prizes are non-transferable, not redeemable for cash, are not applicable toward purchase of gift certificates, taxes, or any items prohibited by law for this type of promotion. No substitutions of the prizes are permitted, except by Sponsor who reserves the right to substitute a prize of comparable or greater value, at its sole discretion. Potential prize winners, or their parents or legal guardians, if potential prize winner is a minor in his/her state of residence, may be required to sign, notarize and return an Affidavit of Eligibility and Liability/Publicity Release and provide any additional information, that may be required by Promotion Entities. Except where prohibited by law, potential winners must return all such required documents within fourteen (14) days following attempted notification or prize may be forfeited. If any winner cannot accept prize, then prize will be forfeited and, at Sponsor’s discretion, awarded to an alternate winner. Prize will be awarded "as is" with no warranty or guarantee, either expressed or implied by Sponsor. The Promotion, and use of the prizes, are subject to these Official Rules. All prize details are at the sole discretion of the Sponsor. All federal, state, local or municipal taxes, if any, or other costs and expenses associated with the acceptance and use of a prize not specified herein as being awarded are the sole responsibility of the winners. Limit one (1) prize per person/Yahoo! email address.

  6. General Rules: An entrant is not a winner of a prize unless and until entrant's eligibility has been verified and entrant has been notified that verification is complete. Potential winners must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. Winners are responsible for all applicable taxes. Return of prize or prize notification as undeliverable may result in disqualification and alternate selection. Winners will be notified by phone/e-mail. Prize will be awarded to the name corresponding to the Yahoo! email address from which the entry originated if winner is a Mobile Entry. By participating in any Daily Drawing in this Promotion, entrants agree to be bound by the official rules and the decisions of the judges, which are final and binding in all respects. Sponsor and its Administrators are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in this Promotion or by any human error which may occur in the processing of the entries in the Promotion. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process; violates the official rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. The Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Promotion if it is not capable of running as planned, including, but not limited to, tampering, unauthorized intervention, fraud, technical or phone line failures or any other problems beyond the control of the Sponsor, and to award prizes from among all eligible Mobile entries received prior to cancellation and all eligible mail-in entries received. By entering this Promotion, entrants agree that Sponsor and its Administrators and each of their respective affiliates, officers, directors, agents, and employees will have no liability or responsibility for any claim arising in connection with participation in the Promotion or any prize awarded. Winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in the Promotion or use or redemption of prize. Acceptance of prize constitutes permission to use winner’s name and likeness for promotional purposes without further compensation except where prohibited by law. Sponsor is not responsible for any typographical or other error in the printing of the Promotion materials or the offering or announcement of the prizes.

  8. Privacy: By entering any Daily Drawing in this Promotion, you are agreeing to provide your personal information to Yahoo! and AT&T, which is subject to the Yahoo!
